2. Service Overview

FairCommonsNetwork offers luxury yacht charter services which include, but are not limited to:

  • Daily yacht rentals
  • Sunset cruises
  • Corporate retreats
  • Private events
  • Multi-day charters

All services are provided based on availability and considering weather conditions. We reserve the right to change or discontinue services at our discretion.

3. Booking and Reservations

3.1 Booking Process

When you wish to book a charter, the requirements are as follows:

  • Be at least 18 years of age
  • Provide complete and accurate details
  • Make payment of the deposit as detailed in your booking confirmation
  • Accept these Terms & Conditions

3.2 Confirmation

We confirm bookings upon the receipt of payment and providing you with a written confirmation. We reserve the right to refuse service to anyone at our own discretion.

3.3 Availability

All charters depend on vessel availability and suitable weather conditions. We try our best to accommodate your requested dates and times.

4. Payment Terms

4.1 Pricing

All quoted prices are in € and tax-inclusive unless stated otherwise. Prices are subject to change without prior notice.

4.2 Payment Schedule

  • Deposit: 50% of the full charter cost payable upon booking
  • Balance: Due 48 hours before the charter departs
  • Additional fees (if applicable): Payable at the end of the charter

4.3 Payment Methods

We accept a variety of payment methods including major credit cards, bank transfers, and certified cheques, and conduct transactions through secure, encrypted channels.

5. Cancellation and Refund Policy

5.1 Customer Cancellations

  • More than 72 hours before departure: Full refund minus processing fees
  • 24-72 hours before departure: 50% refund
  • Less than 24 hours before departure: No refund

5.2 Weather Cancellations

If conditions are deemed unsafe for sailing by our captain, options offered include:

  • Rescheduling your charter at no extra cost to the next available slot
  • Issuing a full refund if rescheduling is not feasible

5.3 Mechanical Issues

If there's a mechanical issue with the assigned boat, we will attempt to provide an appropriate replacement. Should a replacement not be available, a full reimbursement will be issued.

6. Safety and Conduct

6.1 Safety Regulations

It’s required that all passengers:

  • Obey all instructions given by the crew
  • Utilize safety equipment as required
  • Disclose any medical conditions that could affect their safety
  • Remain in designated areas on the vessel

6.2 Prohibited Objects

The following items are not permitted during the voyage:

  • Glass containers
  • Illegal substances
  • Firearms or other weapons
  • Excessive amounts of beverages (beyond reasonable consumption)
  • Pets (unless given prior approval)

6.3 Behaviour

Passengers must behave respectfully. We retain the right to terminate a charter without a refund if any passenger’s behavior creates a risk to safety or significantly hampers others’ experiences.

7. Liability and Insurance

7.1 Our Responsibility

We limit our liability to the value paid for your charter. We do not own responsibility for:

  • Injury caused by a passenger's carelessness
  • Loss or damage to personal belongings
  • Indirect, consequential, or punitive damages
  • Delays arising from weather or factors outside our control

7.2 Insurance Coverage

We carry comprehensive marine insurance for our boats and operations. However, passengers should ensure they have their own personal and travel insurance.

7.3 Risk Assumption

By using our charter services, you recognize that maritime activities carry inherent risks and accept personal responsibility for your safety and welfare.

8. Alterations and Itinerary Changes

We reserve the right to modify itineraries, paths, or schedules as required by weather, safety concerns, or operational needs, with an effort to provide comparable alternatives where possible.

9. Force Majeure

We shall not be held accountable for changes, cancellations, or delays caused by events out of our control, such as:

  • Extreme weather events
  • Natural disasters
  • Government regulations
  • Closures of ports
  • Mechanical breakdowns

10. Privacy and Data Protection

Your personal information will be managed in line with our Privacy Policy. By utilizing our services, you give your consent to the collection and use of your information as outlined in our Privacy Policy.

11. Intellectual Property
